Construction Industry Scheme Private Gardens

HI there

We are a garden and landscape design company. All of our clients are private, apart from a couple of school gardens we've done. We design and construct all of our gardens, including all the hard landscaping. Our accountant thinks we should be part of the CIS scheme as we use and pay a self-employed labourer from time to time. I thought it only applied to new build estates and/or part of wider construction industry. HMRC doesn't seem to give a definitive answer on their website.

  • you are not a construction or civel engernering company you employ sub contractors its up to the sub contractors to have the revelent training to opparate any machinary that they use 

  • it's a bit of a grey area. If your private clients are prepared to pay this occasional self employed labourer directly and that fitted in with your own way of costing the jobs out, etc, then it might bypass the CIS requirement. But please do more research before taking my unqualified opinion as gospel
