VAT exempt plants

It is been brought to our attention over the last few months that the some within our Trade do not appear to know that some plants are VAT exempt.

All Fruit Trees VAT exempt are, along with most 1 litre Herbs.

    Yes thats right. With fruit trees it is obvious that you are growing them for food. Herbs are slightly different because who is to say you are growing them for food? I looked in to growing comfrey and it turned out that if i was selling the crop for human or livestock consumption then it would be zero rated. But if i was growing it to sell the plants on or make organic fertiliser then it would be liable to VAT.

    Yes fruit Trees of any size, and we have sold them up to 30cm girth, are vat exempt

    Trees like Olea, so not normal to fruit in the UK are not exempt.

    We have imported Fruit Trees from Holland, France, Italy and Spain, no vat?

    When we import from EU countries we supply our Vat Number to our supplier which exempts all vat at domestic rate on all imports.

    You may need to give your UK supplier your VAT details to qualify for this.

    If in doubt, have a chat with your local Tax Office.

    If you are VAT registered, any EU imports that you may have, should be VAT free.  You then charge VAT at your domestic rate.

  • Thanks for confirming I'm not mad - I am still registered for VAT in the UK as I have a UK address also, I need this to keep certain insurances alive whilst working 'internationally' this does require according to some HM government employees a nominal work stage in the UK per annum or no work at all anywhere, hence my stint in the UK at present - the VAT issue is just one example where transboundary transactions contravene the treaty of Rome and no one really cares, particularly as you end up paying taxes in 2 countries or more. Definately something people who plan to work elsewhere on the continent need to know before embarking on such lifestyle ideals.
