Employers Responsibilities with Commercial Contracts

I’ve been asked to tender for a grounds maintenance contract for a housing association. This would be a sideways step for the business as I’ve always focused on domestic maintenance.  However as I took on a colleague last year I’m in a position to take on extra work.

Whilst employers/work responsibilities apply wherever you work, is it reasonable to be more apprehensive about commercial contracts for a housing association as there appears to be so much legislation and guidance applicable that you feel something somewhere will be overlooked  that might leave you negligent/liable etc.

Is it reasonable to proceed with the following:

Risk assessment (downloadable from LJN, thank you kindly)

Public liability

Health and safety certificate (construction site?)

There seems to be such a mountain of red tape that it can appear daunting, but is it right to think its a risky move?

    Did you not have public liability previous to this quote?

    Iam sure there's more that other members can fill in 
  • Yes, I've always had public liability, employees liability and the appropriate certificates etc.

    Its more the risk assesment & method statement side thats a bit murky.

    Hi Garry,

    You will need R  A's, M S,s  H & S, COSHH and sometimes even an Environment Policy Statement. You will need 5 & 10 million £ insurance policies, Environment Agency waste carriers licence and probably competancey certificate for operations / machines being worked and operated, ie lantra C & G NPTC  etc etc
