BACKSTABBERS to be polite

We have just been informed by one of our customers that they had been given a leaflet touting for work in which it states that we had gone bust! Shame that now it can not be found so that I can find the culprits. Has anyone else had this happen to them??
Obviously we haven't gone under!!!!

Maybe daft question but is this criminal or civil law breaking? I know that if I know them it will end up being criminal!

  • Been asking round this afternoon round other customers in the area, they've not heard anything still got plenty to ask over the next few days though.

  • Best to obtain the 'evidence' first - if your customer contacted you, how come the leaflet can't be found? Sounds v dodgy esp as no-one else can corroborate.

  • Had something similar at the start of the year when a client rung another gardener who said yes know him he's gone back to OZ. Must admit 90% sure I know who it was as drives off or crosses the street every time I see him, not sure if I should be more pissed with the stealing (as he has my number)of the great customer or saying I went to OZ being a Kiwi and having standards.

  • Return the favour, - he's gone bust because its interfering with his community payback and counselling sessions for gambling and heroin addiction.

  • Sounds like if it could be proven you could sue him for liable.

  • Can't see a criminal issue, but if you have the leaflet there's definitely a claim for damages to your business.

    Any issues with local cowboys running you down, it's amazing how fast news travels when you "suggest" potential clients might need to see a CRB check on someone before employing them. No specific reason, just rumours you've heard that suggest it's in their interest to double-check. The local network of mums at the school gates, retired ladies at the WI, they all pass things on.

    You have a CRB check in place, so it's not affecting you in any way. It sows the seed of doubt in people's minds quite nicely...

    It simple terms If it's in print it's libel, if it's not its slander. Both are civil offences. But you have to prove it. Find a leaflet and see a solicitor as libel is a minefield of legislation.

    This is not a gentlemanly game your competition are playing, so play by their rules?

    Sorry to be cynical but what is your customer up to? Nobody else has heard any such? Is there really a leaflet to be found?

    Does said customer have a commitment to you? Are they trying to slither out of it on the back of a half-heard, misinterpreted overhearing of another's conversation? Can't afford you any more but too gutless to say so and looking for another way out? Wants to try the wife's sister's jobless son who's just starting up but is too gutless to say so?

    My own inclination, once I hadn't been able to find corroberation elsewhere, would be to ignore the customer or to confront them with a demand they produce facts not rumour.

    Andy Kenney asked the question several hours ago. I'm asking it again. Is there any such leaflet?
