Do I need a waste carriers licence?

Hi all,

Could someone put me in the picture ref the licensing situation for garden waste i.e. what sort of licences do i need to take away garden waste and dispose of it? 

At the moment I try not to take any away and the small amount that I do is composted in my garden.

    Bottom line if you make the call as to what to prune / cut then you should be okay with having a license, however if a clients requests that you cut a lawn or hedge work etc. then you have been instructed to perform the task and the waste is not classed as "own waste"
  • I've been looking at this for about a year now and is still not commercially viable for us to have one as yet. We can generally get rid of the waste through composting or other methods. The law is ambiguos to say the least even the environment agency don't quite understand it themselves. They have told us that if you are not under instruction but go in to a garden and get cutting and make the mess yourselves then you don't need a waste licence, however, if you are under instruction then yes you do!!! Try figuring that one out!! The environment agency did advise on getting one just to cover ourselves.

    However I did phone a waste disposal place they did say that realistically they would need to see papers from us. So personally I would advise on getting one, when it's necessary. You will have to factor the waste, your time, any employees time and getting rid of the waste and from what I remember it was about £50 per tonne plus vat. I figured for us, it maybe better to get a skip.
  • Your waste or not, you will definately need a licence if you want to dump waste at a council run site as you will need to of filled out a waste transfer note and therefore must have your registration number on the form. The transfer note includes your name and address, type of waste and clients name and address. I believe it is £152 one off payment for a licence lasting 3years. You are also required to keep a copy for your own records, although i must admit i often forget, as generally i fill out a form as and when on jobs and not when at home when i could run a photo copy off. At the dump site you will be required to have suitable foot wear, hard hat and hi-vis top or they won't let you in!

  • Fair enough, but as i understood it, if you want to dump waste in a trade capacity you must be registered regardless of what site you are using, as you will still need to produce a waste transfer note.

  • Ok i see what you mean, where i am the dump sites have a domestic side and a seperate trade/commercial side with weighbridge.

  • This irritated us at the time we got one mainly because it seemed to be so complicated as Lisa says... even if you just want to compost it yourself - you still are required to have a licence to take it anywhere but... its only a pound a week for the first three years - it's something to do with discouraging fly-tipping isn't it?

    Correct me if I'm wrong, but if you are composting the waste 'off site' (ie at you own address), don't you also need a licence or an exemption for the site where the composting is done ??? This also applies if you are planning to burn any waste off site.

  • Think to be on the safe side of things, i'm going to apply for one of these..better safe than sorry..can anyone tell me if it is the same agency north of the border??
