Just to make you guys aware I have had my renewal come through for my waste carriers license. As I do fences and landscaping am a member of the upper tier there regulations are, this is in an email reply. Please take notice of the statement at the bottom of the email I have highlighted in bold.
The need for a Waste Carrier registration falls within two categories which are either Upper or Lower Tier. Lower tier registrations are only available to specified persons. If you do not fall into any of the following categories then you will need to continue to register/renew as upper tier.
Lower Tier
You can register in the Lower Tier if you act as a waste carrier, dealer and/or broker and are:
• A charity or voluntary organisation;
• A waste collection authority;
• A waste disposal authority;
• A waste regulation authority;
Or you deal only with:
• Animal by-products;
• Waste from a mine or quarry;
• Waste from premises used for agriculture.
A lower tier registration is free and lasts indefinitely unless you withdraw your registration or we revoke it.
Upper Tier
You will need to register for an Upper Tier registration if you are operating a business:
• Transporting controlled waste as part of their business or for profit;
• Arranging for the transport, recovery or disposal of controlled waste on behalf of others, even if they do not take physical possession of the waste;
• Buying and then selling controlled waste through an agent, even if they do not take physical possession of the waste.
An upper tier registration lasts for three years and is chargeable. It current costs £154.00 for new applications and £105.00 for renewal applications (no VAT).

If you are a gardener, landscaper or tree surgeon, you will need an upper tier registration if you are carrying out construction or demolition work and carry the waste produced e.g. fencing, paving, soil;
Currently, you will not need to register as a waste carrier if you just carry trimmings, green wastes etc, which you have produced as part of your work even if you have been given a specific instruction.
After December 2013 waste producers who normally and regularly carry their own waste will need to register in the lower tier.

Thats handy Austin...... just used the shortcut to get the lower tier license. They obviously seem to classify green garden waste along with agricultural which seems sensible.
