Subbing to self employed workers

Im considering 'subbing in' an experienced hard landscaper to assist on some of our jobs this year, probably only one or two days a week, however i have never done this before and im unsure how it works. Do i need to inform HMRC of this or do i just get him to write me an invoice for the hours worked?

Also, will my employers liability insurance cover him or should he have his own?

  • He will need his own insurance, for subbing to be completely above board, he has to have other clients and quote each job individually and supply his own tools.

    Technicaly speaking he will be his own company. So you will be employing his services that way, same as when you get a sparky in to install lights etc.  

  • You will also need to get for your own business, sub contractors and bona fide sub contractors insurance added to your policy depending upon whether you are directing his work or whether he is just turning up and getting on with his job without your guidance.

  • Make sure he is trustworthy in all aspects and that all referrals go to you.
