So glad to have T&C's

As part of my business I hire out Topiary and exotics, mainly for weddings but also to corporate customers. Most recently I was asked to supply 4 Buxus 4ft spirals for an eco event organised by the council every year and held at a national trust property. The hirer was meant to leave the plants in their marque for collection instead they left them lined up outside the marque. When I arrived early on the monday morning after the event only three were left standing where they had left them. I couldnt believe that people who would exhibit at this event would do this, it really does challenge your faith in human nature.Luckily I have terms and conditions in place to cover these loss's and the customer has had to pay for a replacement at wholesale prices and minus the rental charge already paid.Has anyone else had a situation in which they have needed to enforce their terms and conditions and been glad they were in place?

    Yes.

I have Terms relating to cancelling my maintenance visits. I reserve the right to charge people the full cost of a visit if cancelled less than 3 days before I am due to arrive.

Some customers have even said that they don't want their garden maintained as we arrive on site - unbelieveable! Others have left security gates shut (no code/key fob supplied) or gates locked when they are usually open.

I have enforced this but I am usually able to find enough work instantly so I only charge the customer for actual lost time. People who are charged a cancellation are usually only charged once - they are much better at giving notice in the future!
  • why minus rental? they had your plant stolen !
  • We have numerous clients who damage hire stock, try to default on payment…especially over the last 12 months. We currently have two cases on going via our debt collection agency and I am just about to issue Letter Before Action notice against a particularly obnoxious little toad, who seems to think that he can ignore our event hire check sheet and T&C’s…I’m going enjoy making him sweat.

I think that you are being especially generous by only charging trade prices, we charge full retail + an administration fee + VAT and whilst it has not yet happened there is also a clause for lose of income against other hires, should the plants in question be needed.

    T&C’s are essential.
