Are your contracts fair ?

Lots of businesses have terms and conditions that set out the obligations of both themselves and their customers.  But remember, the fairness of these terms in consumer contracts is covered by The Unfair Terms in Consumer Contracts Regulations.

 

Most consumers DO NOT fully read contracts. Moreover, the law agrees that consumers should be free to focus on the main elements of the deal, confident that there will be no unwelcome surprises in the small print, if there are and they were not specifically drawn to their attention, it is very unlikely that it will be possible to rely on them.

 

Make sure:

 

  • Terms and conditions are written in plain English.
  • They are as short as possible. Pages and pages are unnecessary and could make all the terms unfair.
  • The font size is legible.
  • They are given to the customer before they agree the contract. If they are given afterwards they will not be part of the contract.
  • They are balanced and fair.
