Sleep walking into pension auto-enrollment

Our staging date is fast apporaching so I have been involved with our Accountants setting up and making key decisions regarding Pension schemes etc. I have decided to let our Accountants administer the scheme and use a software package add on to Sage Payroll to help calculate and monitor the pay levels every month to determine who is eligable etc.

I've read a lot over the past few months to ensure I know of my obligations as a Ltd company with employees, but found this useful mini summary specifically for those who are Sole Owners/no employee businesses : Demystifying auto-enrolment for Britain’s sole business owners

  • Thanks for the valuable advice Gary, I'll complete my first year as a sole operator in April but know I need another pair of hands this season to cope.

It's difficult to know whether to try and employ a self- employed contractor or go down the route of a 'proper' employee. This would be preferred but of course its a bit daunting trying to make sure everything is set up properly for them.

I find expressions like , partners and directors in the same sentence, less than clear...

We are partners and by definition like sole traders not directors or employees. To my mind we would, if we had a Ltd company, be co-directors.

But as we have a partnership, we are partners.  We are not 'employed' or employees or directors.

And likewise, if we were sole-traders, again not 'employed' or an employee or a director

It would be useful, for the purpose of de-mystifying, if it read..

If you are a Sole-trader, or a Partner in a partnership,  (and by definition 'not employed') in these circumstances you are:-

    a. not required to auto-enrol

    or

    b. we still have no idea how to handle you 'people', we will probably make it up as we go along, your best bet will be to ring us up, listen to options 1-55, guess which option sounds likely and if you're lucky you will speak to someone who knows the answers. :-)
