Criminal record disclosure checks ruled 'unlawful'

The High Court this afternoon ruled the criminal record checks scheme used in England and Wales was "arbitrary" and unlawful.

As many Contractors need such disclosure to satisfy various vetted schemes (such as Trading Standards) it will be iinteresting to see how this plays out.......

  • Interesting. So what do they suggest? Some jobs need checks, like those dealing with vulnerable people or the sick and elderly, children etc.

    • I think this only applies to your employer but not so if you work for yourself? Also to satisfy contracts eg working for the council near vulnerable people. We have no DBS in place formally, and there seem to be no protections for the vulnerable people we come across, nobody has ever asked us, but I think we would need it to enter into certain contracts. Im sure there are insurance implications. We were asked if we worked with children etc and the insurance price would have increased but other than that I think it's a bit vague and not regulated to my knowledge.
