This is one to watch. This could have quite an impact on the landscape industry if the same rules were applied.

Travel time has always been contentious for businesses in our industry running mobile crews.

Time spent travelling to and from first and last appointments by workers without a fixed office should be regarded as working time, the European Court of Justice has ruled. This time has not previously been considered as work by many employers.

The ruling means firms including those employing care workers, gas fitters and sales reps may be in breach of EU working time regulations.

  • Agrreed Phil, very interesting. It would have a big impact on fuel costs for those that travel a long way to their first and last clients too, presumably. Comes too late for me now, but would have saved me a lot of precious pounds a few years ago when I had no fixed yard space.

    I think it levels the playing fields and should benefit employees. We've always paid for travel time, so our "cost base" already covers this and it may actually be beneficial by ensuring when tendering it's like for like.

  • I can see a few 'interesting' conversations coming up!  As we work from a base, the lads' are paid from when they arrive in the morning and leave in the evening, so travelling time is paid.  I think also that if a boss takes on a job, say 30 miles from home, it is only right that he pays the employees travelling time and factors that in the price.

  • I have always paid staff from the time they arrive at base to the time they get back, I don't think anything else is really fair and it's shocking that this is only just being legislated.
    I would be sceptical whether or not employees become aware of this, or employers change their work hour calculations.
  • I find it completely beyond my understanding.

    My friend commutes on two trains and a long walk to his office, at least 90 minutes each way if the trains run to time.
    An employee with no fixed office base can now claim travelling time even if it's 5 minutes from home?

    • I think the rationale is that an employee knows where an employer is based and therefore can choose whether or not the commute time to/from office, lockup or other is acceptable. If they then have to travel to a site, other office, customer etc this would then form part of the working day.

        Agree with you on that. No one is forced to take a job an hour or more commute away.
        I don't employ anyone but I think I would pay from getting in van at the start of the day to end of day
