Spraying for weeds

I'm currently employed by a landscaping company that is getting us to spray for weeds, but none of us have our pa1 and pa6 certificates which I know you need to do this legally. Can I just refuse not to do it? We have a few big food chain contracts that we do the maintenance for and that requires spraying. Surely we would get in big trouble if asked to produce our certificates?

  • Do you want to ruffle feathers? Sometimes you need to think carefully. How badly do you need your job? I suspect if the worst happened and it went to court it would be the boss that's held responsible, not you.

    • Ruffle feathers with who? My boss?

Talk to your boss Matt. He should be aware of his responsibilities.

It is a legal requirement that operatives are Pa1 & Pa6 (for knapsack) certified.

However I'm yet to hear of successful prosecution. The policing of the system for rogue operators is poor.

    • .......and from what I've seen recently around our way, many of those holding their certificates, have very little idea of the potency of the substances used, with great swathes of grass verge killed off by drift, dribbling and over spraying around obstacles.

  • What protective equipment are you provided with? I've seen guys no gloves mixing, spraying, messing with nozzle, hands in tank then sitting in van eating lunch
    • We are provided with only gloves. And some people don't even use them!!
  • My understanding is that if one person is qualified in PA1 and 6 then they can supervise someone else even if they don't hold the certificate

I might be wrong and I am not sure where I got that idea from

That's true Simon but the supervisor must accompany the person (or persons) and must always maintain visual contact.

    • Don't think that's allowed anymore
  • With a employee would the HSE get involved, not trained for job etc. Who is supposed to enforce?
