The Construction (Design and Management) (CDM) Regulations 2015 came into force in England, Wales and Scotland on 6th April 2015.

They replace the 2007 CDM Regulations and have been predicted to increase statutory duties, particularly for small contractors.

Commenting in January 2015, Paul Reeve, Director of Business Services for the Electrical Contractors Association (ECA) acknowledged efforts to "curtail" the regulatory burden on small firms, but he added "It's clear that many small businesses will pick up extra duties in the future' under this Act.

Under the 2015 Regs a principle designer must be appointed when two or more contractors are present on site and all contractors must have appropriate skills, knowledge and experience to carry out the work they have been employed to do.

Another key change is the replacement of the CDM co-ordinator role with a 'principle designer role', who is a member of the design team responsible for ensuring projects comply withy regulatory requirements.

Projects are also now notifiable if the are expected to last more than 30 days and involved more than 20 people working on the project simultaneously, or exceed 500 person days.

For the first time residential property projects are also covered by the regulations. However, residential clients will usually be able to transfer their legal duties to the contractor, principle contractor or principle designer.

  • I was sent a link today for an app called CDM Wizard, it is for android and ios but it creates a kind of risk assessment/ method statement with the extra details need to comply to the basic level of the new CDM regs. The app was created by CITB.
