    So, the original quote was completed to the original spec + removal of shrubs (extra labour time, more waste etc)?

    and she's emailed with:

     "Please forward your invoice for the work completed on Friday as agreed via your quote".

    And then contradicted herself?

    • She's saying that the shrubs should have been included in the original quote as that's what she specified. That's certainly not how I interpreted her spec above.
  • From recent experience and on advice from trading standards I can tell you that if there is the slightest alteration to your original spec by either party it has to be considered a new contract, it comes under the `selling at home' law.

    Under these rules when any change is made a contract / quote needs to be submitted and a cooling off period given, so for example if you re asked to remove a tree but then they change their mind and ask for it to be pruned instead, that's a new contract, the old one doesn't now matter, so if you go along with their wishes and then present them with an invoice for the same price they can refuse to pay, not only that but also refuse to pay for all the other work too as you don't have a valid contract, now it gets worse, the client at this point can say, well as there is no contract in place why did you still dig up my borders / cut my hedges or whatever work was carried out? and then claim compensation from you for damages to her property.

    This has resulted in me losing about a thousand pounds on a perfectly good job, it was either pay up / reduce the bill or be taken to court, I have had one other try this on but I became suspicious and emailed him a new price which he then backed out off even though it was lower than the original price.

    Watch out guys, there are some awfully well clued up people out there who will take advantage of the law to screw you over.

  • All very interesting. Some real bad people out there then. Well I got one too, that still owes me money. Gonna sort that out this winter. LOL
