    Just to quantify I've no legal training:)
    • I do this for many clients that have a 'home office'. I would think it more important that you only make the bill out to the business if he pays you from the business account with the same name. Of course, you could make it out to him personally and he could claim on expenses.

    Changed my mind:) I don't think it's a problem for either of you. As long as he's not trying to claim it as a business expense and therefore pay less tax it's no one business if he make his own business pay rather than himself.

  • as long as you are declaring everything its fine. what he does with it and what risks he chooses to take is up to him

    No problems as far as Ive ever come across. As long as your invoice stands scrutiny with HMRC, what your client does and how he decides to pay is his concern ( as long as no money laundering takes place and/ "or you're knowing complicit)

    Hope not most of my big clients have the works made out to businesses for personal or security reasons and none of those are anywhere near the home address.

    I think the HMRC issue will likely be with the Client passing off personal expenditure (ie you're doing the Bosses garden ) as Company expenditure thus bypassing the client's P11D - Benefit in Kind liability

    This is perfectly acceptable. For a number of years I worked on a regular basis for a "Media type person". I cut their (extensive) lawns at their lovely house and would present a monthly bill invoiced to their company and delivered through the office door which was in another town away from their home. i was assured by the accountant that this was perfectly acceptable. How they choose to pay it was their affair.

  • To me (and this is not based on any relevant training just my own thoughts) it seems like it is not all above board. Any invoice made out to a business and that gets paid by the business will surely go through the accounts and be classed as a business expense and so reduce the amount of tax that company pays. If the work is purely for the residential home of somebody who works for/owns the company then I would say it is not right. Whilst I do not think you could get in any trouble for it, to my mind the individual asking for the invoice to be amended is doing this to save on their tax bill. As stated i'm not even remotely qualified and could be totally wrong! Maybe there are many legitimate reason to do it.
